Scope This licence applies to original software, source code, website code, documentation and other material that Vladan Colovic (the Licensor) makes available under this licence (the Software). It applies only to rights the Licensor owns or is authorised to license. Third-party material remains subject to its own terms. The permission to view source code is not permission for unrestricted business use. 2. Free personal use The Licensor grants each natural person a worldwide, non-exclusive, royalty-free licence to download, install, run, copy, inspect, study and modify the Software for that person's own personal use, subject to this licence. Personal use expressly includes trading, investing, research, analysis and record-keeping for the individual's own beneficially owned personal accounts, using real money and seeking or earning profit. Profit, trading frequency, trading as a main source of income, or the tax classification of that activity does not, by itself, make it Business Use. Using a broker or other paid platform to trade for oneself does not, by itself, make it Business Use either. Personal use excludes use for a legal entity's account, use on behalf of an employer, client or other person, and activity carried out as part of employment, a business service or contractual work for others. A person's employment by a company does not prevent genuinely private use outside their work duties. 3. Personal sharing and modifications An individual may share original or modified copies without charge with other individuals for their own personal use, and may publish such copies as a non-business community contribution. Include this complete licence and all applicable copyright and attribution notices; identify modifications and their author; and provide the corresponding source code with any executable copy. Recipients receive only the permissions in this licence. This permission does not allow commercial distribution, paid access, business sponsorship arrangements that supply the Software as part of a business offering, or redistribution on behalf of a business. Modified copies remain subject to these restrictions to the extent they contain or derive from the Software. No permission is granted to represent a modified copy as an official SVKO release. 4. Business Use requires a separate paid agreement No permission for Business Use is granted under sections 2 or 3. Before Business Use, contact the Licensor and obtain a separate written commercial licence agreement and pay the fees required by that agreement. Sending an enquiry alone does not grant permission. Business Use includes: (a) installing, running, copying, modifying or deploying the Software by or for a company, partnership, organisation or other legal entity, including internal use, testing, evaluation, research, analysis, trading and reporting; (b) using the Software as part of employment, professional duties, consultancy, brokerage, advisory services, proprietary trading for a firm, or services for clients or other people; (c) integrating, embedding, white-labelling, bundling, distributing, supplying, installing or maintaining the Software as part of a business product, platform, service or customer offering; (d) hosting the Software or providing its functionality or outputs to others as part of a business service, whether through a website, API, remote desktop or another interface; and (e) selling, licensing, renting or otherwise commercially exploiting the Software or modified copies, except for the individual's own trading expressly allowed in section 2. These conditions apply whether or not the Software is modified, whether or not its source code is published, whether it runs on a server or a user's computer, and whether it is charged for separately, bundled into another charge, or supplied free of charge. Supplying it free to brokerage clients is Business Use. Employing an individual to obtain or distribute it does not create a personal-use exception. An end user's personal-use permission does not license a business's integration, distribution or other Business Use. 5. Public access and enquiries Anyone may read the publicly accessible website, documentation and source code, including for the purpose of assessing or requesting a commercial licence. Ordinary browser rendering and incidental copies necessary for this reading are permitted. Anyone may link to the public website without reproducing or delivering the Software as a business feature. This does not permit running or deploying the trading tools for business evaluation, or hosting, adapting or redistributing the website as a business website. Third-party rights and applicable law Third-party material remains subject to its own terms. This licence grants no rights to third-party platforms, accounts, market data, trademarks or dependencies. Nothing in this licence overrides rights arising independently under applicable law or third-party licences. 7. No warranty; limitation of liability The Software is supplied as is and as available, without warranties, to the extent permitted by law. The Licensor does not warrant accuracy, reliability, fitness for a purpose, non-infringement, trading results or uninterrupted operation. The Software is not investment advice. You are responsible for your use and trading decisions. To the extent permitted by law, the Licensor is not liable for losses or damage arising from the Software or its use, including trading losses, lost profit, lost data, service interruption and indirect or consequential damage. Nothing in this licence excludes liability or rights that applicable law does not allow to be excluded. 8. Termination and other terms The permissions granted by this licence terminate if you breach its conditions. On termination, stop exercising those permissions unless the Licensor reinstates them in writing. Sections concerning retained rights, warranty and liability survive termination. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. No support, updates, exclusivity or trademark rights are promised. Rights not expressly granted are reserved. There is no automatic conversion to another licence after a period of time.
